Terms of Service

SmartBench Software provides services with the following terms. Custom Software and Consulting terms of service are outlined on their respective contracts. The following applies to products and services such as Renaissance or fs.place.

PLEASE NOTE THAT THE TERMS OF THIS AGREEMENT ARE SUBJECT TO CHANGE BY SMARTBENCH SOFTWARE IN ITS SOLE DISCRETION AT ANY TIME. By continuing to use our services and products, you agree to any changes of this policy.
 

  1. Limitation of liability

    1. Any users of any product or service provided by SmartBench Software are expected to thoroughly test and evaluate using “sandbox” or non-critical data. SmartBench Software is not responsible for any loss of data, disruption or business activities or damages caused by our software.

  2. Refunds

    1. Refunds will only be provided under discretion of SmartBench Software. Refunds will only be considered when the provided software is defective in a manner that cannot be reasonably fixed or an alternative provided. 

  3. Support

    1. Services are provided without support or warranty. Support may be provided upon request, with any costs to be made known up front.

    2. All software and services are provided “as-is”

 

Privacy Policy

BY ACCESSING OR USING SMARTBENCH SOFTWARE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS PRIVACY POLICY AND OUR TERMS OF USE. IF YOU DO NOT AGREE TO THE POLICY AND TERMS OF USE, DO NOT USE THE SERVICE.

 

  1. Information we collect and receive

    1. Account and Profile information.

    2. Billing Information

    3. Communications, such as emails.

    4. Onshape Account information

      1. When you utilize any SmartBench Software tools integrated with Onshape, we receive additional information about your Onshape account

    5. Log data

    6. Device Information

    7. Geo-location information

    8. Usage Data

  2. Retention and Deletion

    1. We will only retain your personal information for as long as necessary to fulfill the purposes for which it was collected and processed, including for the purposes of satisfying any legal, regulatory, accounting or reporting requirements.

    2. In some circumstances, we may anonymize your personal information so that it can no longer be associated with you, in which case it is no longer personal information.

  3. Geographic Location

    1. For all users, your information may be processed in either Canada or the United States.

  6. Changes to our Privacy Policy

    1. We may change this Privacy Policy from time to time. We will prominently post any changes we deem to be material, and/or otherwise ensure that you are aware of them. If you continue to use SmartBench Software services after any changes are in effect, you will be deemed to agree to the revised policy

  7. Sharing and Disclosure

    1. SmartBench Software cares about your privacy. Consistent with that philosophy, we do not sell or monetize your data or information with any third party. We limit sharing your data to the following situations:

      1. Account support

      2. Legal Compliance

      3. Communicating with you

      4. Integrity, Security, and fraud detection
